Lululemon sues Under Armour for patent and trademark infringements

The Vancouver-based athleisurewear company claims that four of Under Armour’s sports bras are similar to Lululemon Athletica Inc.’s Energy Bra and that “Under Armour’s unauthorized acts have caused and will continue to cause irreparable damage to Lululemon and its business.”
In 2012, Lululemon sued Calvin Klein for allegedly copying the waistband design on its $98 Astro Pant, eventually settling out of court.
Patent lawyers say this type of lawsuit is rare in the fashion industry due to the trouble and expense involved in obtaining design patents for their products.
